PlanetGPU Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PlanetGPU website, APIs, datasets, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.

1. Access to the Services

  • You must be at least 18 years old or the age of majority in your jurisdiction to use the Services.
  • You agree to provide accurate contact information when requesting demos, subscribing to updates, or engaging in commercial discussions.
  • We may update, suspend, or discontinue any part of the Services at any time. Substantial changes will be communicated in advance whenever feasible.

2. Acceptable use

  • Do not scrape, mine, or harvest data beyond rate limits granted by your subscription or plan.
  • Do not attempt to circumvent authentication, security controls, or uptime protections.
  • Use the Services only for lawful purposes and in compliance with applicable regulations.
  • Respect third-party intellectual property rights contained within provider logos or metadata.

3. Accounts and credentials

If you create an account or receive API credentials, you are responsible for safeguarding access tokens and for all activity that occurs under your account. Notify us immediately at security@planetgpu.com if you suspect unauthorized access.

4. Intellectual property

PlanetGPU owns all rights, title, and interest in the Services, including compiled datasets, derived insights, and brand assets. You may reference our data for internal analysis, but redistributing large portions of the index without written permission is prohibited. Providers retain ownership of their respective trademarks and logos.

5. Disclaimers

The Services are provided "as is" without warranties of any kind. Pricing, availability, and metadata are sourced from third parties and may change without notice. PlanetGPU disclaims liability for procurement decisions made from the information provided.

6. Limitation of liability

To the fullest extent permitted by law, PlanetGPU shall not be liable for indirect, incidental, consequential, or punitive damages, nor for lost profits or revenues arising from the use or inability to use the Services. Our aggregate liability under these Terms is limited to the amount paid to PlanetGPU in the 12 months preceding the event giving rise to the claim.

7. Termination

We may suspend or terminate access to the Services if you violate these Terms or applicable laws. You may stop using the Services at any time. Sections relating to intellectual property, disclaimers, limitations of liability, and governing law will survive termination.

8. Governing law

These Terms are governed by the laws of the State of California, excluding conflict-of-law principles. Any disputes will be handled in the courts located in San Francisco County, California.
